1. Acceptance of Terms

Welcome to Articulated. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Articulated ("we," "us," or "our") governing your access to and use of the Articulated mobile application ("App") and all related services (collectively, the "Service").

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms.

2. Description of Service

Articulated is an AI-powered speech coaching application that helps users improve their communication skills. The Service includes, but is not limited to:

• AI-driven conversational practice across real-world scenarios such as job interviews, meetings, social situations, public speaking, and more
• Real-time voice interaction with an AI conversation partner
• Post-session analysis across seven dimensions of communication, including Clarity, Pace, Confidence, Filler Words, Vocal Variety, Conciseness, and Fluency
• Progress tracking and personalized improvement insights
• Support for multiple languages

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of the Service without notice or liability.

3. Account Registration

To access certain features of the Service, you may be required to create an account. When registering, you agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain and promptly update your account information to keep it accurate, current, and complete
• Maintain the security and confidentiality of your login credentials and not share them with any third party
• Accept responsibility for all activities that occur under your account
• Notify us immediately at support@articulated.app if you suspect any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, outdated, or incomplete, or if we reasonably believe your account has been compromised.

4. Subscriptions and Payment

Articulated offers subscription-based access to premium features. All subscriptions are managed and processed through the Apple App Store or Google Play Store (collectively, "App Stores"), with subscription management powered by RevenueCat.

4.1 Billing and Renewal

Subscription fees are billed in advance on a recurring basis according to the billing cycle you select (weekly, monthly, or annually). Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the end of the current period. Payment will be charged to your App Store account upon confirmation of purchase.

4.2 Price Changes

We reserve the right to adjust subscription pricing at any time. Any price changes will take effect at the start of the next billing cycle following notice of the change. Your continued use of the Service after a price change constitutes acceptance of the new pricing. If you do not agree with a price change, you may cancel your subscription before it renews.

4.3 Cancellation

You may cancel your subscription at any time through your device's App Store settings. On iOS, navigate to Settings, then Apple ID, then Subscriptions. On Android, navigate to Google Play, then Payments and Subscriptions. Upon cancellation, you will retain access to premium features until the end of your current billing period. Cancellation does not entitle you to a prorated refund for the remaining portion of your billing period.

4.4 Refunds

Refund requests are handled by the respective App Store through which you made your purchase (Apple for App Store purchases, Google for Play Store purchases). We do not process refunds directly. Please contact the relevant App Store support for refund inquiries. We are happy to assist you through the process if needed.

5. Voice Data and Content

5.1 Voice Recordings

The Service processes your voice recordings in real time to provide AI-powered conversation practice and speech analysis. Voice recordings are processed transiently for the purpose of generating analysis results and are not stored permanently on our servers. 5.2 User Content

You retain ownership of any content you create, submit, or generate through the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to process your User Content solely for the purpose of providing, maintaining, and improving the Service.

5.3 Analysis Results

The speech analysis results, scores, and feedback generated by the Service ("Analysis Results") are produced using artificial intelligence and are provided to you for your personal use. We may use aggregated and anonymized Analysis Results to improve the Service, but we will never share individually identifiable Analysis Results with third parties without your explicit consent.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party's use of the Service
• Attempt to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks connected to the Service
• Use any automated means, including bots, scrapers, or similar tools, to access or interact with the Service
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Service
• Use the Service to generate, transmit, or store content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Use the Service for any commercial purpose without our prior written consent, including but not limited to reselling access to the Service or its outputs
• Circumvent, disable, or otherwise interfere with security-related features of the Service, including features that prevent or restrict use or copying of any content

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this section, including removing offending content, terminating accounts, and reporting violations to law enforcement authorities.

7. Intellectual Property

The Service, including but not limited to the App, its design, features, functionality, AI models, algorithms, text, graphics, logos, icons, images, audio, and software, is owned by Articulated and is protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use, in accordance with these Terms. This license does not grant you any right, title, or interest in the Service or its content beyond what is expressly stated herein.

The "Articulated" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Articulated. You may not use such marks without our prior written permission.

8. Disclaimers

8.1 AI-Generated Analysis

The speech analysis, feedback, scores, and coaching provided by the Service are generated by artificial intelligence and are intended solely for educational and informational purposes. The Service is not a substitute for professional speech therapy, medical advice, psychological counseling, or any other form of professional advice. AI-generated analysis may contain inaccuracies, and you should not rely solely on the Service for making important personal or professional decisions.

8.2 No Professional Advice

Nothing in the Service constitutes professional medical, psychological, therapeutic, or clinical advice. If you have concerns about a speech or communication disorder, social anxiety, or any other health condition, you should consult a qualified healthcare professional. The Service is designed as a self-improvement tool and is not intended to diagnose, treat, cure, or prevent any medical condition.

8.3 Service Availability

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that any defects will be corrected. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.

8.4 Third-Party Services

The Service may integrate with or rely on third-party services, including but not limited to cloud infrastructure providers, AI model providers, App Store platforms, and payment processors. We are not responsible for the availability, accuracy, or reliability of any third-party services, and your use of such services is governed by their respective terms and policies.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Articulated, its officers, directors, employees, agents, affiliates, successors, or assigns be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service, including AI-generated analysis and feedback
• Unauthorized access, use, or alteration of your transmissions or content
• Any decisions or actions taken based on the analysis, feedback, or recommendations provided by the Service

In no event shall our total aggregate liability to you for all claims arising out of or relating to the use of the Service exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty United States dollars (USD $50.00), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

You may terminate your account at any time by discontinuing use of the Service and canceling any active subscription through your App Store settings. Upon termination, your right to use the Service will immediately cease.

The following sections shall survive any termination of these Terms: Intellectual Property, Disclaimers, Limitation of Liability, Governing Law, and any other provisions that by their nature should survive termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction and venue of such courts. Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of our intellectual property rights.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will notify you by updating the "Effective Date" at the top of this page and, where appropriate, provide additional notice through the App or via email.

Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription. We encourage you to periodically review these Terms to stay informed of any updates.
